Privacy policy

This Privacy Policy describes how CELLAR TECHNOLOGIES MÉXICO, S.A.P.I. DE C.V. ("TalkAgent", "we") collects, uses, safeguards and transfers the personal data of everyone who uses the TalkAgent platform (the "Service"), both the businesses that subscribe ("Customers") and the end customers who interact over WhatsApp with a Customer's agent ("End Users").

1. Data we collect

• Customer account data: business name, email address, password (stored encrypted).
• Data of the agents the Customer invites to their account: email address, password (stored encrypted) and the device identifier used to send them push notifications about the conversations they handle.
• Documents the Customer uploads to the platform (menus, catalogs, policies, prices, and similar) to train their agent.
• Content of WhatsApp conversations between the agent/Customer and their End Users, including the End User's phone number.
• Billing and payment data, processed directly by Stripe — TalkAgent does not store card numbers.
• Customer tax data, captured only from the web panel: RFC, legal name, postal code, tax regime, CFDI use, billing email and, optionally, phone, address, notes and the Customer's proof of tax status (Constancia de Situación Fiscal) as a PDF.
• Technical usage data (access logs, IP address, browser type) for security and support purposes.

2. Purposes of processing

• Operating the Service: generating automated responses based on the Customer's documents (RAG) and delivering them over WhatsApp.
• Managing the account, subscription and recurring billing.
• Issuing the invoice for the Customer's subscription using the tax data they register themselves.
• Providing technical support and responding to Customer requests.
• Detecting misuse, preventing fraud, and complying with legal obligations.
• Improving the Service (for example, analyzing aggregate usage patterns, never the content of individual conversations outside of their operational purpose).

3. Who we share data with

To operate the Service, we share data with the following providers, solely for the purposes described:

• Twilio Inc. — sending and receiving WhatsApp messages.
• Meta/WhatsApp — as the messaging platform the Service runs on.
• Amazon Web Services (AWS) — infrastructure hosting, document storage and running the AI model (Amazon Bedrock / Anthropic Claude).
• Stripe Inc. — payment processing and billing.

We do not sell personal data to third parties.

4. Data retention

We keep data for as long as the Customer's account remains active, plus any additional period needed to comply with legal, tax or audit obligations. The Customer can delete their documents at any time from the panel. Conversations can be hidden from the inbox from the panel — if the same end customer writes again, the conversation reappears with its history, so no attention context is lost. To request permanent deletion of conversations, the Customer can write to us at hi@cellartech.net.

Tax data and the constancia PDF are stored privately and encrypted, are not shared with third parties, and are deleted when the account is deleted. The Customer can update them or replace the constancia at any time from the web panel.

The Customer can remove an agent at any time from the web panel: their access is revoked immediately and their user is deleted. Deleting the Customer's account also deletes the users of all of their agents.

5. Your rights

As the owner of your data, you have the right to access, rectify, cancel, or object (known in Mexico as ARCO rights) to the processing of your personal data, and to withdraw your consent. To exercise these rights, write to us at hi@cellartech.net including your name, the right you wish to exercise, and the information needed to locate your data.

6. Security

We apply reasonable technical and administrative measures to protect personal data against damage, loss, alteration, or unauthorized access or use, including encryption in transit and role-based access control within our AWS infrastructure.

7. Changes to this policy

We may update this Privacy Policy periodically. We will post any changes on this same page with the corresponding update date.
